General Terms and Conditions

1. Scope and contracting party

These Terms and Conditions apply to orders placed through the online shop of JW Tech GmbH, Auf der Ahl 33, 65207 Wiesbaden, Germany, email: contact@jw-tech.eu. A consumer is a natural person entering into a transaction predominantly for purposes outside their trade or profession. A business customer is a natural or legal person or partnership with legal capacity acting in the course of its commercial or self-employed professional activity.

2. Offer and conclusion of contract

Product presentations in the shop are not binding offers. The customer adds products to the basket, completes checkout and submits a binding offer using the final order button. An automated acknowledgement only records receipt of the order. The contract is formed when JW Tech expressly accepts the order, dispatches the goods or accepts payment, whichever occurs first.

3. Contract language and storage

The contract may be concluded in German or English. Order data is stored as required by law. Registered customers can view orders in their account. An order confirmation is sent to the email address provided at checkout once the shop's email delivery has been activated.

4. Products and technical information

The description, properties and compatibility information on the relevant product page are authoritative. Images may differ slightly, particularly in packaging, colour or product revision, provided the agreed characteristics and ordinary use are not impaired. Customers should check suitability for their intended overall system before ordering; statutory defect rights remain unaffected.

5. Prices and shipping costs

Prices displayed to consumers include statutory VAT where applicable. Shipping and any other legally required costs are displayed in the basket or checkout before the order is submitted. Unless expressly agreed otherwise at checkout, deliveries to the United Kingdom and Switzerland are made DAP (Delivered at Place, Incoterms® 2020). The recipient is responsible for import clearance and must pay import duty, import VAT and any customs or carrier clearance/disbursement fees not included in the shop price.

6. Payment

Only the payment methods offered to the customer at checkout apply. Until further online payment methods are activated, advance payment by bank transfer is generally available to public customers. Payment by invoice is offered only to customer groups expressly approved for it. Cash on delivery and direct debit are not offered as general payment methods. For advance payment, the amount is due after receipt of the payment instructions and dispatch takes place after payment has been received.

7. Delivery

Delivery is offered to EU Member States, the United Kingdom and Switzerland. The delivery time applicable to the product and destination is displayed in the shop. Partial deliveries are permitted where reasonable for the customer; additional shipping costs are charged only if agreed in advance.

8. Retention of title

Goods remain the property of JW Tech GmbH until paid for in full. For business customers, retention of title also applies until all claims arising from the ongoing business relationship have been settled.

9. Consumer right of withdrawal

Consumers have the statutory right of withdrawal in accordance with the separate withdrawal instructions. The instructions, model withdrawal form and electronic “Withdraw from contract” function remain accessible through the shop footer.

10. Defect rights

Statutory liability for defects applies. For business customers, the limitation period for defects in newly manufactured goods is one year from delivery where such a limitation is legally permitted. This does not apply to fraudulent concealment, guarantees, injury to life, body or health, or intentional or grossly negligent conduct.

11. Liability

JW Tech has unlimited liability for intent and gross negligence, injury to life, body or health, under product liability law and within expressly assumed guarantees. For a slightly negligent breach of an essential contractual obligation, liability is limited to the foreseeable loss typical for the contract. Liability for other slight negligence is excluded to the extent permitted by law.

12. Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

13. Applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice does not remove mandatory protection granted by the law of their country of habitual residence. Where legally permitted, Wiesbaden is the place of jurisdiction for merchants, legal persons under public law and special funds under public law.
